Terms of Service

Last updated: [Date] · Effective for all purchases from thetolldocket.com

These Terms are a binding contract. By checking the consent box at checkout and completing your purchase, you confirm you have read, understood, and agree to every section below, including the No-Refund Policy in Section 6.

1. Who we are and what this is

[Business Legal Name] ("the Company," "we," "us," or "our") operates The Toll Docket, a website that sells a written informational product (the "Docket") describing a documented correspondence sequence used with the MTA Toll Payer Advocate program for MTA Bridges and Tunnels toll violations.

The Docket is content: written text, including example message language, that you may choose to adapt and send yourself. It is not a service performed on your behalf. We do not contact any tolling authority, government agency, or third party regarding your account, your violations, or your case. We do not review your specific case before or after purchase unless you separately request and pay for that.

2. Not legal, financial, tax, or debt advice

The Company is not a law firm, and no part of the Docket, this website, or any related communication constitutes legal advice, financial advice, tax advice, or credit counseling. We are not attorneys and no attorney-client relationship is created by your purchase or use of the Docket.

The Company is not a debt adjuster, debt settlement company, debt negotiation company, credit repair organization, or credit counseling agency, and does not hold itself out as any of the foregoing. We do not negotiate, settle, or adjust any debt or violation on your behalf. Any reduction, discount, payment plan, or other outcome relating to your toll violations is determined solely and exclusively by the applicable tolling authority (including but not limited to MTA Bridges and Tunnels, the Port Authority of New York and New Jersey, and the New York State Thruway Authority), acting in its own discretion, and not by the Company.

You are solely responsible for any communication you send to any tolling authority, government agency, or other third party. You send all communications yourself, from your own account or email address, in your own name.

3. No guaranteed outcome

We make no promise, warranty, or guarantee of any specific result, including but not limited to any specific discount percentage, any specific payment plan term, approval of any request, reinstatement of any suspended registration, or any dollar amount of savings. Any figures, ranges, percentages, case studies, or examples shown on this website (including the savings gauge/calculator) are illustrative estimates based on limited, anonymized past cases and general information about the relevant public programs. They are not a prediction, quote, or guarantee of your outcome. Your results depend on factors outside our control, including your balance, documentation, the reviewing agency's discretion, and matters we have no visibility into.

4. Eligibility and intended use

The Docket is designed around MTA Bridges and Tunnels toll violation balances generally under $15,000. It may not be suitable for larger balances, balances involving multiple agencies, balances already in active court judgment or third-party debt collection, or circumstances requiring individualized legal advice. Purchasing the Docket does not obligate us to confirm your eligibility or suitability for the program it describes.

You must be at least 18 years old and legally able to enter into a binding contract to purchase from this website.

5. Payment and delivery

Prices are shown in U.S. dollars and are due in full at the time of purchase. Payment is processed by a third-party payment processor (for example, Stripe, Gumroad, or Lemon Squeezy); we do not store your full payment card details. Upon successful payment, the Docket is delivered electronically, typically by email, to the email address you provide at checkout. It is your responsibility to provide an accurate email address and to check your spam or promotions folder if delivery is not immediately visible in your inbox.

6. No-refund policy

All sales are final. Because the Docket is digital content that is delivered to you immediately and irrevocably upon purchase, and because its value depends on it being unseen prior to purchase, we do not offer refunds, credits, exchanges, or cancellations for any reason once the Docket has been delivered — including but not limited to: change of mind, dissatisfaction with the content, your case not resulting in the outcome you hoped for, your case being ineligible for the program described, or any action or inaction by a tolling authority.

By completing your purchase, you expressly acknowledge and agree that you waive any right to a refund, and, to the extent permitted by applicable law, you consent to immediate delivery of digital content and waive any statutory withdrawal or cooling-off period that might otherwise apply to digital products.

The sole exception is a verified technical failure of delivery (for example, you did not receive any copy of the Docket at all due to an error on our end). In that case, contact [Support Email] within 7 days of purchase and we will re-send the Docket. Re-delivery, not a refund, is the exclusive remedy for non-delivery.

Chargebacks or payment disputes filed in place of contacting us first may be treated as a breach of these Terms and may result in the disputed amount, applicable fees, and this clause being provided to the payment processor and, where applicable, pursued as a debt owed to the Company.

7. Intellectual property

The Docket, this website, and all associated text, design, and materials are owned by the Company and protected by copyright and other intellectual property laws. Your purchase grants you a limited, non-exclusive, non-transferable license to use the Docket for your own personal, individual case. You may not resell, redistribute, publish, share, republish, or create derivative products from the Docket without our prior written consent.

8. User conduct and representations

You represent that any information you provide to us is accurate. You agree not to use the Docket or this website for any unlawful purpose, including submitting false statements to any government agency. You are solely responsible for the truthfulness and accuracy of any hardship statement, financial representation, or other content you send to any tolling authority using language adapted from the Docket.

9. Disclaimer of warranties

The Docket and this website are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the information in the Docket is current, complete, or error-free, or that any tolling authority's program, policies, or procedures described will remain unchanged after your purchase.

10. Limitation of liability

To the maximum extent permitted by law, the Company, its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of income, savings, or expected discount, arising out of or related to your use of the Docket or this website, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability to you for any claim arising from your purchase will not exceed the amount you paid for the Docket.

11. Indemnification

You agree to indemnify and hold harmless the Company and its owners, employees, and contractors from any claim, demand, loss, or liability, including reasonable attorneys' fees, arising out of your use of the Docket, your communications with any tolling authority, or your violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of your purchase governs that purchase. Material changes will be reflected by an updated "Last updated" date at the top of this page.

13. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your purchase will be resolved exclusively in the state or federal courts located in [County, New York], and you consent to personal jurisdiction there. [Optional: insert binding arbitration / class-action-waiver clause here if your attorney recommends one.]

14. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding your purchase.
